INMOBILIARIA PROACTIVA S.A. will establish procedures, measures, and controls to adequately process personal data of its owners, in compliance with the General Data Protection Regulation established under the applicable legal framework.
The Personal Data Processing Policy is prepared in accordance with the Political Constitution, Law 1581 of 2012, Regulatory Decree 1377 of 2013, and other complementary provisions.
INMOBILIARIA PROACTIVA S.A. will apply these policies to the information it accesses, collects, stores, uses, shares, updates, and generally processes as part of its professional activities.
For the purposes of this policy and in accordance with applicable regulations, the following definitions are included:
a) Authorization: Prior, express, and informed consent of the Data Subject to process personal data.
b) Privacy Notice: A physical, electronic, or other document provided by the Controller to the Data Subject detailing the data processing policies, access methods, and intended purpose of data processing.
c) Database: An organized set of personal data subject to processing.
d) Personal Data: Any information linked to or that may be associated with one or more identifiable individuals.
e) Public Data: Data classified as such by law or the Constitution, including information related to civil status, profession, trade, or status as a public servant, among others.
f) Private Data: Data intimate or reserved by nature, relevant only to the Data Subject.
g) Sensitive Data: Data that affects the Data Subject’s privacy or whose misuse may lead to discrimination, such as racial or ethnic origin, political opinions, religious or philosophical beliefs, union membership, sexual orientation, health, and biometric data.
h) Company: INMOBILIARIA PROACTIVA S.A.
i) Processor: A person or entity that processes personal data on behalf of the Controller.
j) Controller: A person or entity that decides the purpose and means of processing personal data.
k) Data Subject: The individual whose personal data is being processed.
l) Processing: Any operation on personal data, such as collection, storage, use, sharing, or deletion.
The following principles will be harmoniously and integrally applied:
a) Legality: Processing must adhere to the applicable legal framework.
b) Purpose: Processing must serve a legitimate purpose and inform the Data Subject.
c) Freedom: Processing requires prior, express, and informed consent unless legally exempted.
d) Veracity/Quality: Data must be truthful, accurate, complete, and understandable.
e) Transparency: Data Subjects must have unrestricted access to their data and its processing.
f) Access and Restricted Circulation: Data processing is subject to legal and constitutional limitations.
g) Security: Measures must ensure data integrity and prevent unauthorized access or use.
h) Confidentiality: Data processors must maintain confidentiality, even after their contractual relationship ends.

a) Manage relationships with clients, suppliers, and employees.
b) Provide information about the Company and its products/services.
c) Notify about new products, services, or changes to them.
d) Update client/user information.
e) Consult financial or credit reporting agencies.
f) Share institutional, advertising, or commercial information.
g) Conduct studies, research, or market analysis.
h) Process employment applications.
i) Evaluate the quality of services provided.
j) Fulfill legal and contractual obligations.
Data Subjects have the right to:
a) Access, update, and correct their personal data.
b) Request proof of data processing authorization.
c) Inquire about the use of their data.
d) File complaints with the Superintendency of Industry and Commerce for data protection violations.
e) Free access to their data being processed.
INMOBILIARIA PROACTIVA S.A. must:
a) Ensure Data Subject rights.
b) Maintain data integrity and confidentiality.
c) Respond to queries and complaints.
d) Notify the Superintendency of data security violations.
Before or during data collection, INMOBILIARIA PROACTIVA S.A. will request Data Subject consent, informing them of the purpose of the processing.
